Further damage claims are not possible. The organiser reserves the right to cancel the program on short notice if participants cause the fulfilment of a contract to be endangered or made impossible by their behaviour, omissions or other actions that are not in accord with Norwegian law. In this case, the regulation of the cancellation costs applies in accordance with number 5.

Good health is necessary in order to take part in all activities. The participants are obligated to inform the organiser of any possible health problems.
Under no circumstances may participants take part in the activities while under the influence of alcohol, drugs, psychiatric drugs or any similar substances. The participants are obliged to fulfil the conditions of participation and agree to strictly follow the instructions of the organiser, the guides, the activity leader, drivers or front personnel.
If the Conditions of Participation are not fulfilled or instructions are disregarded, the organiser reserves the right to prohibit participation.
8. Travel Insurance
In line with our commitment to ensuring a seamless travel experience, we highly advise obtaining a travel insurance policy in your home country that covers your cost should you have to cancel your travel reservation with short notice. This form of travel insurance is reasonably priced and often extends coverage to various other risks. Acquiring travel insurance is a prudent choice for global travel and adventure travel, and its significance is heightened, particularly with the global warm and sudden weather changes, as well as the recent episodes of the last pandemic.
The organiser does not insure the participants. Everyone who Visits Norway has the right of free health care in the case of an accident.
9. Acceptance of risks
You acknowledge that adventure travel and the products and services offered by the Organiser may involve a significant amount of risk to your health and safety. By travelling with the Organiser you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risks and release the Tour Operator from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, including adventure travel specifically, visiting foreign destinations, and participating in adventurous activities such as those included in Tour itineraries or otherwise offered by the Tour Operator. The Tour Operator requires that you confirm your assumption of this responsibility by completing the participation waiver (the Waiver) prior to departing on your tour. The Waiver is available at http://www.outdoornorway.com/waiverr
You acknowledge that the degree and nature of personal risk involved depends on the products or services booked and the location(s) in which a product or service operates, and that there may be a significant degree of personal risk involved in participating, particularly participating in physical activities, travel to remote locations, carriage by watercraft, participation in extreme sports or other high-risk activities, or travel to countries with developing infrastructure. You acknowledge you have considered the potential risks, dangers and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.
You must strictly comply with all applicable laws and regulations. Failure to do so or engaging in illegal activities may result in the immediate termination of your travel arrangements at your expense, without any liability on the Tour Operator's part. No refunds will be provided for unused services or costs incurred due to the termination of your travel arrangements.
10. force majeure
The Tour Operator is not liable for any loss, injury, delay, or failure to fulfil duties if caused by factors beyond their control, termed as "Force Majeure." Such factors include, but are not limited to, Acts of God, war, mechanical breakdowns, terrorism, civil commotions, government interference, labour difficulties, extreme weather, significant health risks (e.g., Covid-19), or any other cause whatsoever beyond the reasonable control of the Organiser or the Third Party Supplier of services, whether or not foreseeable, which would make it dangerous or not viable for a Tour to commence or continue, any and all of which, individually and collectively, constitute Force Majeure.
11. IMAGES AND MARKETING
You agree that, while participating in any Tour, images, photos or videos may be taken by other participants, the Organiser or its representatives that may contain or feature you. You consent to any such pictures being taken and grant a perpetual, royalty-free, worldwide, irrevocable licence to the Tour Operator, its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.
12. Privacy Policy
The Organiser must collect your personal information to deliver the Tour and any products or services booked. The Organiser collects, uses and discloses only that information reasonably required to enable the Organiser and its Third Party Suppliers to provide the particular Tour, products and/or services that you have requested as described in the Organiser Privacy Policy, which can be accessed any time at http://www.outdoornorway.com/gdpr-privacy-policy and is expressly incorporated into these Terms. By submitting any personal information to the Organiser, you indicate your acceptance of the Organiser Privacy Policy.
13. SEVERABILITY
If any provision of these Terms is so broad as to be unenforceable, such provision will be interpreted to be only so broad as is enforceable. The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.
14. Appeals
Should the activity lead to appeals or damages, these are to be communicated immediately, in writing, to the activity leader (i.e. activity provider), and these are to be confirmed in writing by the responsible leader. The activity leader, however, shall not have the right to acknowledge claims, for which reason a confirmation shall not have the effect of an acknowledgement of wrongdoing. The activity leader (i.e. activity provider) will make every effort, within the confines of the program and the possibilities available, to remedy the situation. Should the situation be insufficiently remedied or not be remedied, or the participant wishes to make damage claims, the organiser must receive these within four weeks of the contractual end of the activity at the booking agency. The participant appeal is to be accompanied by the confirmation of the activity provider/activity leader and any other relevant evidence. In the case of delayed complaints or complaints with omissions during the activity or delayed submissions of the claims at the booking agency, all appeals will be deemed invalid.
15. General liability
Damage claims against the organiser or the assistants are excluded as far as the damage was not caused by negligence or intentionally. The organiser is authorised to have assistants or call on third parties to provide valued services. Should the organiser lawfully transfer the execution of the activity to a third party, the organiser shall not be held responsible for the third party’s actions or neglect during the execution of the activity. The organiser will especially not be held responsible for damages which are caused by the actions or neglect of the activity leader should this conduct not fall under his/her contracted responsibility; as the cause of actions of third parties, other participants, the participant (especially under point 1), acts of God, natural occurrences, official regulations etc or damages caused by delayed return to the starting point of the activity. Should the participant not follow the instructions of the organiser, activity leader, etc, all liability of the organiser is dropped.
16. Applicable Law and Area of Jurisdiction
Norwegian law, excluding international agreements, is exclusively applicable to the contractual relationship. The parties agree that the exclusive legal domicile is Voss. The organiser is, however, authorised to lodge a claim in the legal domicile of the customer in case of inappropriate conduct of participants.
Should one or more clauses of these general business conditions be ineffectual and/or incomplete, then the clause that comes closest to the legal rule will replace the ineffectual and/or incomplete clause. The ineffectualness and/or incompleteness of one clause leaves the effectiveness of the other clauses unaffected.
17. Debit & Credit Card payments
Card payments are very safe and collected by Fareharbor, which acts as an authorised reservation and booking platform for Outdoor Norway AS. Subsequently, Fareharbor uses Stripe, and it will appear as OUTDOOR NORWAY on your credit/debit card statement.
For Private departures, Customisable tours or arrangements with advanced agreement we will send a payment link via Stripe, with directed connection with Outdoor Norway Stripe account.
All of them are PCI-compliant and powered by a trusted processor.
